You may have found yourself having to deal with the HR aspects of
- buying or selling a business,
- taking on or losing a service contract.
Any of these circumstances can trigger TUPE requirements to apply.
The rules of TUPE offer protection to employee rights and apply when there is an employee transfer to a new employer.
We can help you get to the right outcome for the employees and your business.
TUPE stands for the "Transfer of Undertakings (Protection of Employment) Regulations 2006" as amended by the "Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014".
TUPE has impacts for the employer who is making the transfer (also known as the outgoing employer or the transferor) and the employer who is taking on the transfer (also known as the incoming employer, the 'new employer' or the transferee). TUPE regulations carry tricky legal requirements that both parties must satisfy and there is also the need to deal with the preparations of losing or taking on of new employees and everything involved in this.
At Lighter HR Solutions we can help you manage the TUPE transfer process whether you are the outgoing or the incoming employer. We have supported clients with TUPE transfers and are experienced in handling all of the challenges that these requirements bring. We will work with you to make sure that you are not just meeting the legal requirements but that the process is managed effectively to enable a smooth employment transition for your departing or incoming employees.
